Harvey Weinstein could take 18-24 years in prison, arrested three times on three charges

Harvey Weinstein was convicted of three counts of rape and sexual assault. But in a split verdict, the jury acquitted him of one other charge and couldn’t make a unanimous verdict on three other counts, report Variety. The jury convicted Weinstein of raping an Italian model, named Jane Doe, in the Mr. C hotel in February 2013. At the trial, Weinstein was arrested in april 2013 for the crime, retributing a class of Italian classmate who was convicted of a fraud.

The jury cleared him of the sexual battery of a massage therapist, identified as Jane Doe #3. And they were split over two others accusers, Jennifer Siebel Newsom and Lauren Young. The jury approved 10 o’clock and 7 to convict her on a charge of sexual battery against Young; and 8 o’clock, betraying shebel Newsom with the charges of rape and forcible oral copulation.

The jury decided the three charges against the judge were suspended. District Attorney George Gascon said the office will decide later whether to retry Weinstein on those counts. Weinstein was sitting in a grey suit in the court room, and didn’t immediately react when the verdict was read. The lawyers Gloria Allred and Beth Fegan represent many of his accusers.

In a statement, Jane Doe #1 thanked the prosecution for believing in me and fighting in the process with all the victims, including me, in the case.

Harvey Weinstein had destroyed a part of me that night in 2013 and I didn’t expect to get it back, she said. The trial was brutal, and the trial lawyers of Weinstein put me through hell on the witness stand. However, I knew that I should have seen this to the end, and I would hope that Weinstein never sees the outside of a prison cell during his lifetime.

Depending on what charges he was found guilty for rape, oral copulation and penetration by a foreign object, Weinstein faces 18 to 24 years in prison. The jury isn’t finished, because it will have to come back to trial on Wednesday morning, to hear arguments in the case over aggravating a fact that will influence Weinsteins sentence.

No penalty has been set. After the approbation of Weinstein, the client sex of the massage therapist, the jurors were asked to consider the misdemeanor version of the same offence. The jury split two tries in favour of an arrest for the misdemeanor count. If he was convicted of the misdemeanor, the charge would’ve been thrown out due to a statute of limitations.

The jury began debate on December 2, and their debates lasted 40 hours. The former Hollywood titan was charged with seven counts in total: two counts of forcible rape, two counts of sexual battery by restraint, two counts of forcible oral copulation and one count of penetration by a foreign object.

The four accusers alleged that Weinstein sexually assaulted them in hotels in Los Angeles and Beverly Hills between 2005 and 2013. If he was convicted of all charges, Weinstein would’ve faced up to 60 years to life. Weinstein, 70, is already serving 23 years in prison after being convicted of sexual assault and rape in his first criminal trial in New York in 2020.

New York Court of Appeals, the state’s highest court, is expected to hear the appeal of that conviction in the next year. Weinstein was jailed since July 2021 in the Twin Towers Correctional Facility in downtown Los Angeles, after being extradited from New York. He’s confined to a wheelchair and suffers from diseases such as diabetes, sleep apnea, cardiac, and eye disease.

Siebel Newsom, wife of Gov. Gavin Newsom in California, said that Weinstein raped her in 2005, after she arrived for what she thought was a business meeting.

That trial was a deep reminder that we’ve got work to do as society. To all survivors in there I see you, I hear you, and I stand up with you.

Gov. Newsom said that he is very proud of my wife and all the brave women who came forward to share their truth and upliftcountless survivors who cannot. Newsom continued to show the power, courage and conviction of his strength, and is an inspiration to us all. We must fight to ensure that survivors are supported and their voices heard.

The prosecution also called for four witnesses with prior bad actions to support the charges, among other items, Ambra Battilana Gutierrez, Italian model who was the center of an internal sting operation against Weinstein in 2015. The prosecutor described Weinstein as a predator in the closing arguments, and gave the jury a call for the jury to turn his terror over.

The accusers took over their relationship with the producer because of the power of entertainment. They played the game, said the defenseman of Weinstein, Alan Jackson. They hate it now, without equivocal consent, and that hate made their testimony concrete.

More than one hundred women have made public appearances over the last five years. Gascon stated in a statement that he was disappointed with the split on some counts. He thanked the accusers for coming forward and for their cross-examination.

Gascon said they fear their fearlessness. They deserve better than they were given by the system.
